Local PA Pool Opening

On this day, Desmond Pools & Spas, Inc. (“Contractor”) and customer (s) named below intending to be legally bound agree as follows:

1. Customer agrees to pay Contractor the amount of ___$285__ + tax (the “Service Agreement Price”). Please note that pricing will reflect all final services selected on this contract.

2. Contractor agrees to open one (1) in-ground pool. The following is a complete description of the work to be performed, materials to be used, and/or other specifications:

- Cleaning folding cover without products

- Removal of all winter plugs, filters & heater (up to two (2) pumps and two (2) filters)

- Prime, start up and bleed air from the system

- Installation of all diving boards, handrails or ladders (if in safe conditions to be used)

3.Service agreement price does not include:

- Any repairs to cover

- Any repairs or leaks for heater and/or filter equipment

- Any warranties beyond those offered by a manufacturer

10.Customer agrees to ensure that the water level is filled to mid-skimmer prior to the pool being opened. If the water level is not filled to mid-skimmer, a second service will be required if system cannot be started at time of opening an additional cost will be charged at this time.

11.Customer agrees that if the cover is not dry at the time of pool opening for any reason, including, but not limited to inclement weather when the pool is opened, it will be need to be put out to dry and Customer will be responsible for doing this if they choose to.

12.Contractor cannot guarantee a specific day for a pool opening due to events beyond the control of Contractor, including, but not limited to inclement weather.

13.The prices set forth above are based upon the information that was provided to Contractor by Customer through the Site Evaluation Form attached to this Agreement. Customer agrees that any discrepancy in the information provided may result in Customer incurring an additional cost.

14.Contractor is not responsible for any damage to property caused by settling or heavy machinery.

15.The attached Desmond Pools & Spas, Inc. Standard Terms and Conditions and any other documents expressly identified in this Agreement are incorporated by reference.

16.This Agreement, including the Terms and Conditions and any other documents expressly identified herein, constitutes the entire understanding between Contractor and Customer. It supersedes and rescinds all prior or contemporary agreements or understandings between Contractor and Customer and may be modified only in writing signed by both Contractor and Customer.

17.At the time this Agreement is executed, Contractor shall provide and deliver to Customer, without charge, a completed copy.

18.Contractor agrees to maintain liability insurance covering personal injury in an amount not less than $50,000 and insurance covering property damage caused by the work for Contractor in an amount not less than $50,000. At the time of signing, Contractor maintains insurance in the amount of $100,000.

19.Right of Rescission: Except as provided in the emergency provisions of the Unfair Trade Practices and Consumer Protection Law, an individual shall be permitted to rescind this Agreement without penalty regardless of where the Agreement was signed, at any time prior to midnight of the third (3) business day after the date of this transaction.

20.Cancellation: Except as provided in #19 above or (1) unless no substantial portion of the contracted work has been performed at the time termination and a refund are requested in writing by Customer and (2) more than 45 days have elapsed since the starting date identified above, this Agreement may not be cancelled by Customer.

7 .COVER SERVICE: Contractor recommends folding covers be cleaned and stored for the season. This service is not included in the service agreement price, but can be added at an additional cost of $150. If Customer elects to add cover service, cover will be removed and cleaned with an anti-fungal product, dried thoroughly, and stored for the season. Cover will also be inspected for holes and/or areas that may require repairs. Cost of repairing any holes and/or areas are not included and will be quoted separately.

*Bi-weekly customers are responsible for maintenance between visits by Contractor. Contractor is not responsible for excessive debris or lack of water quality due to Customer’s failure to complete any and all required maintenance.

9.Description of the work to be performed, materials to be used, additional services added and other specifications shall not be changed without a written change order signed by the Customer and the Contractor, which contains any accompanying price change.

10.Customer agrees to ensure that the water level is filled to mid-skimmer prior to the pool being opened. If the water level is not filled to mid-skimmer, a second service will be required if system cannot be started at time of opening an additional cost will be charged at this time.

11.Customer agrees that if the cover is not dry at the time of pool opening for any reason, including, but not limited to inclement weather when the pool is opened, it will be need to be put out to dry and Customer will be responsible for doing this if they choose to.

12.Contractor cannot guarantee a specific day for a pool opening due to events beyond the control of Contractor, including, but not limited to inclement weather.

13.The prices set forth above are based upon the information that was provided to Contractor by Customer through the Site Evaluation Form attached to this Agreement. Customer agrees that any discrepancy in the information provided may result in Customer incurring an additional cost.

14.Contractor is not responsible for any damage to property caused by settling or heavy machinery.

15.The attached Desmond Pools & Spas, Inc. Standard Terms and Conditions and any other documents expressly identified in this Agreement are incorporated by reference.

16.This Agreement, including the Terms and Conditions and any other documents expressly identified herein, constitutes the entire understanding between Contractor and Customer. It supersedes and rescinds all prior or contemporary agreements or understandings between Contractor and Customer and may be modified only in writing signed by both Contractor and Customer.

17.At the time this Agreement is executed, Contractor shall provide and deliver to Customer, without charge, a completed copy.

18.Contractor agrees to maintain liability insurance covering personal injury in an amount not less than $50,000 and insurance covering property damage caused by the work for Contractor in an amount not less than $50,000. At the time of signing, Contractor maintains insurance in the amount of $100,000.

19.Right of Rescission: Except as provided in the emergency provisions of the Unfair Trade Practices and Consumer Protection Law, an individual shall be permitted to rescind this Agreement without penalty regardless of where the Agreement was signed, at any time prior to midnight of the third (3) business day after the date of this transaction.

20.Cancellation: Except as provided in #19 above or (1) unless no substantial portion of the contracted work has been performed at the time termination and a refund are requested in writing by Customer and (2) more than 45 days have elapsed since the starting date identified above, this Agreement may not be cancelled by Customer.

21.For information regarding Contractor’s registration with the Pennsylvania Bureau of Consumer Protection (the “Bureau”), Customer may contact the Bureau at the following toll-free phone number: 1-888-520-6680.

22.EXPIRATION: Until accepted, the total cost and work described above constitutes an offer only. This offer shall automatically expire unless Contractor receives a fully executed Agreement and the first down payment within seven (7) calendar days of the date the offer is provided to Customer (see above).
